Significance of a Signed Contract
Additional Insured or Waiver of Subrogation Endorsements are frequently issued on a "blanket" basis, meaning the endorsement will not specifically identify the entities requiring the coverage or waiver. Blanket insurance endorsements will typically contain verbiage that indirectly affords additional insured coverage or grants the waiver of subrogation rights under the policy, but only when it is required by written contract. Typically, this type of insurance endorsement will include verbiage that states:
"Any Person(s) or Organization specified in a written contract that requires such coverage and/or waiver to be furnished."
Ultimately, if you have are in a situation where no signed contract exist, this type of endorsement can be problematic, as the carrier can potentially deny coverage or refuse to waive their right to subrogation.
